Terms And Conditions
General Terms and Conditions for the use of Shell Card Online Services
This service is available to all customers who have accepted and signed the Shell
Cards Agreement and have an active account with Shell Oman Marketing Company SOAG.
Use of Online Services
a. Online Services allows authorized users to manage orders relating to their
Cards, retrieve information about Card transactions, update card limits, set time/date/site/product
restrictions and analyse this information using the reporting facilities available
as part of Online Services.
b. Prior to applying for Online Services, the Customer shall notify Shell
of the name and e-mail address of a named User designated as administrator of the
Customer account(s) and who can add Users to such accounts. All Users shall receive
a User ID and password to gain access to Online Services. Shell may e-mail such
access information to the e-mail address(es) provided.
c. The Customer shall be responsible for the use of Online Services by any
authorised or unauthorised persons who use the User ID and password provided to
the customer to gain access to Online Services. In particular, the Customer shall
be liable for any losses suffered by Shell or other parties that are adversely affected
by unauthorised use of the User ID and password because the Customer failed to keep
the Access Code a secret.
d. The Customer guarantees that Users are authorised representatives and
shall undertake to guarantee that Users: (a) shall not divulge the Access Code to
other parties; (b) shall not save the Access Code in a digital or other file; (c)
shall not perform any actions that could lead to unauthorised parties gaining access
to Online Services; (d) shall take all reasonably required steps to prevent unauthorised
parties from gaining access to Online Services; (e) shall comply with any further
instructions issued by Shell regarding the use of Online Services or the mandatory
security measures, and (f) shall notify Shell in writing or by digital means as
soon as they become aware that an unauthorised person may know the Access Code or
can gain access to Online Services or the data contained in or derived from it.
e. Shell retains the right without prior notice to request Users to change
their Passwords and if it has good reason to suspect that a User has violated the
provisions under this agreement, to invalidate an Access Code, disable the Card(s)
and/or terminate this Agreement. Shell may fulfil a User’s request to change an
Access Code, but shall be under no obligation to do so.
f. Users shall be entitled to (a) consult the data obtained via Online Services,
and (b) view information insofar as the reporting facilities of Online Services
allow this. Shell’s prior written permission shall be required for any other use
of the data obtained via Online Services (including reproduction and publication).
Users shall not be permitted to make Online Services or any data obtained as a result
of the use of Online Services available to third parties, irrespective of the manner
in which or the purpose for which this would be done.
g. Shell shall not provide any guarantees relating to Online Services or
the data contained in it. The Customer shall accept Online Services and the data
provided via these services “as they are”, and any use of Online Services shall
be for the account and risk of the User. Shell undertakes to use reasonable knowledge
and care in order to guarantee that the Shell website and Online Services are available
to Users. However, the Customer shall accept that it is technically impossible for
Shell to guarantee that the Shell website and Online Services will be available
at all times, and Shell shall not undertake a commitment to provide such uninterrupted
availability.
i. The Customer (and, via it, also the User):
(i) change the format of Online Services;
(ii) change the content, design, specifications or technical structure of Online
Services;
(iii) change the data types that are mandatory or provided via Online Services;
(iv) deny Users access to or use of Online Services;
(v) carry out all maintenance, repairs and improvements required to ensure the proper
functioning of Online Services, in which case Shell may:
(i) Temporarily interrupt Online Services (without prior
notice in the event of an emergency); and/or
(ii) Issue Users with instructions it reasonably deems to
be necessary;
(vi) temporarily interrupt Online Services in circumstances where it is entitled
to terminate the Agreement or in order to perform one or more of the above-mentioned
activities; and/or
(vii) cancel Online Services (in which case any fees for Cards and corresponding
services shall be adjusted).
Amendment of Terms and Conditions
Shell has the right to amend these Terms and Conditions at any time. The Customer
shall be informed in a timely manner of any amendments to these Terms and Conditions,
which shall be published on
www.shellomancardsonline.com
If the Customer continues to use
the Card(s) after amendments have been made to the Terms and Conditions, it shall
be deemed to have agreed to the amendments.
Applicable law
These Terms and Conditions shall be governed by and construed in accordance with
the Sultanate of Oman law. The Commercial Court in Muscat, Sultanate of Oman shall
have jurisdiction to settle any dispute between the parties hereto related to any
matter herein where such dispute fails to be resolved by mutual amicable agreement
between the parties hereto.
